1. Parties

These terms apply to any engagement with Lucky Heavy Diesel Maintenance Limited (NZBN 9429050791576, Company No. 8461283, "LHD Maintenance", "we", "us"). By requesting or accepting a service from LHD Maintenance, you ("Client") agree to these terms.

2. Scope of Service

LHD Maintenance provides mobile heavy diesel mechanic services including but not limited to engine repair, hydraulic systems, preventive maintenance, fleet contract servicing, and emergency breakdown recovery across Hamilton, Waikato, and the wider North Island corridor. Services are performed by qualified personnel at the location specified by the Client.

3. Quotes and Pricing

All quotes are estimates based on the information provided at the time of enquiry. Final pricing may vary based on actual labour time, parts required, and conditions found on-site. For fleet contract clients, pricing is governed by the applicable rate card agreed at the time of contract execution. All prices are exclusive of GST unless stated otherwise. LHD Maintenance is GST registered (IRD 136736361).

4. Payment Terms

Payment is due upon completion of service unless alternative terms are agreed in writing for fleet contract clients. Accepted payment methods: bank transfer, EFTPOS, and cash. Invoices unpaid after 30 days may attract interest. Fleet contract clients are invoiced monthly in accordance with their contract agreement.

5. Access and Site Requirements

The Client is responsible for providing safe and legal access to the equipment and site. LHD Maintenance reserves the right to decline or cease work where site conditions present unacceptable health and safety risks. Any charges for attendance will apply where work cannot proceed due to Client-controlled site conditions.

6. Warranties and Liability

LHD Maintenance warrants that services are performed with reasonable skill and care in accordance with New Zealand industry standards. Parts supplied are subject to the applicable manufacturer warranty. LHD Maintenance's aggregate liability for any claim arising from a service engagement is limited to the value of that specific service. LHD Maintenance is not liable for consequential losses, including downtime costs, lost revenue, or contract penalties. The Consumer Guarantees Act 1993 may apply where the Client acquires services for personal use.

7. Cancellation

Callout appointments cancelled with less than 2 hours notice may attract a cancellation fee equivalent to the applicable callout charge. Fleet contract clients should refer to their contract for cancellation and notice terms.

8. Governing Law

These terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.

9. Updates

LHD Maintenance may update these terms from time to time. Current terms are published at lhdmaintenance.co.nz/legal/terms. Continued engagement after a material update constitutes acceptance of the revised terms.
